Please review the following Privacy Policy (the “Privacy Policy”). This Privacy Policy outlines how <div>ersity PBC, a Colorado Public Benefit Corporation (“we” or “us”) collects, uses, and shares your information, as the owner and operator of hirediversity.us (or our affiliated websites, together the “Site”).

1. Scope of the Privacy Policy

This Privacy Policy applies to information that we collect or use during your use of the Site. This Privacy Policy does not apply to other websites over which we have no control, although links to such websites may be presented on the Site, including the websites of job posters, employers, employment agencies, or advertisers. We are not responsible for the privacy policies or practices of other parties or websites. We reserve the right to amend this Privacy Policy at any time in our sole discretion. If we materially amend this Privacy Policy, you will be notified by email or through a prominent notice posted on the Site.

2. Information Collected by the Site

We directly collect information about you that you provide when you use the Site, either as an employer or user leaving a review or otherwise engaging with features of the Site. We receive and store this information that you voluntarily provide to us through the Site, including any information provided as an employer or as an individual (e.g. name, email, demographic information, resume, geographical information) or in any other manner, such as third-party log-in authentication systems (e.g., Facebook/Twitter) that may be offered on the Site. This information you provide us is completely voluntary and may include options within this Site on the extent to which you are willing to have this information displayed on the Site (e.g. demographic information of a reviewer).

We may also collect information from you automatically during your visit to and use of the Site, including but not limited to, your IP address and device ID, date and time of visit, and web browser used, as well as through cookies, web beacons, or other web tracking tools. The information that is collected about you includes information that is considered “Personal Information,” which means any information that could reasonably be used to directly identify a natural person. Personal Information does not include aggregated or anonymized information, any publicly-available information about you, or information about you that is provided by third parties (“Non-Personal Information”). Examples of Non-Personal Information include: physical location information; demographic information; or any other personal information that has been anonymized, aggregated or de-identified. Nothing in this Privacy Policy restricts the sharing of Non-Personal Information, which may be shared with third parties at our discretion.

We are not responsible for any additional information that you provide directly to any other users or third parties (e.g. in response to a job listing), and we encourage you to familiarize yourself with third-party privacy practices before disclosing information directly to any such third parties.

3. How the Site Uses your Information

By registering an account to use the Site or engaging with features of the Site, you consent for the Site to use your information in various ways, including but not limited to: for employers, creating a publicly viewable employer profile based on information you have provided; and for reviewers, displaying the content of any review you enter on the Site along with any demographic or personal information you opt to allow to be publicly displayed.

Additionally, the Site may in its discretion use your information to:

  • provide targeted, or location-based content, services, and advertising on the Site and third parties;
  • generate reports about the use of the Site and aggregate data on the Site’s users, which reports may be produced by third-party service providers;
  • contact you (i.e. through email) with promotional materials and other information of interest (if you decide at any time that you no longer wish to receive such communications from us, you may unsubscribe through the link provided in any of the communications);
  • provide you with personalized content and services offered by <div>ersity;
  • moderate and display the employer profiles, employer reviews, and other content you have submitted;
  • customize and improve the features, performance, and support of the Site;
  • use for internal operations, including troubleshooting, data analysis, testing, research, and service improvement; and
  • communicate with you or initiate communication with you on behalf of third parties through your <div>ersity account or through other means such as email, telephone (including mobile phone), or postal mail, including through the use of contact information that you provide to us or (where it is lawful for us to do so) that we otherwise obtain from third-party resources.

Information you post to public areas of the Site (including any areas that may be viewed by other users of the Site) may be accessed, used, and stored by third parties around the world. We cannot control how others may use this information.

4. Sharing of Your Personal Information

We will not sell your Personal Information to any third party, but your Personal Information may be shared by use with third parties either through the features of the Site itself (within your control) or in the following circumstances:

With Your Consent: When you expressly consent to allow us to share your Personal Information for specific uses, this includes through accepting any notices on the Site. This may include leaving your demographic or other personally identifying information on any review or within any employer profile.

With Our Service Providers and Vendors: As reasonably needed to operate the Site, your Personal Information may be shared with certain third-party service providers, vendors, agents, and other persons who assist us in providing the Site and making its services generally available. Such third parties may access your information only as necessary to perform their functions and such parties will be required to adhere to confidentiality obligations. The Site may also share aggregated information with third parties to allow such third parties to serve advertisements online.

With Employers/Job Posters: If you follow any link provided by an employer, such as a job listing, the Site may automatically direct you to the applicable third-party website, which process may include sharing information with that employer or other parties posting employment opportunities or diversity initiatives on the Site. By indicating your interest regarding an opportunity (e.g., by pressing “apply” to any posting), your personal information may be shared with the party or parties responsible for the job posting under the terms of our agreement with such party.

In Order to Comply with Applicable Law: We will disclose your Personal Information if legally required to do so, or at our discretion, pursuant to a request from a government entity or if we believe in good faith that such action is necessary to: (i) meet legal requirements or comply with legal process; (ii) protect our rights or property, or that of affiliated companies; (iii) prevent a crime; or (iv) protect the personal safety of other users or the public.

With Affiliates: We may share your Personal Information with business entities that we control or that are under our common control with us, who may use and share your information on the same terms as disclosed in this Privacy Policy.

In Connection with the Purchase of Our Business: We may transfer your Personal Information to an acquirer (and its affiliates or agents) as part of any sale of the business, whether such acquisition is by way of merger, consolidation, or purchase of all or a substantial portion of our or our assets. You will be notified of such an event by email or through a prominent notice posted on the Site. This may also include as part of an insolvency proceeding or dissolution. Personal Information will not be sold independently as an asset of our business.

5. How We Store Information

We may retain certain information about you (including Personal Information) in an effort to make repeated use of the Site more efficient and practical. As an employer, you may can change or remove certain information by accessing, reviewing, correcting, updating, changing, or deleting your account information or profile at any time. Although we can keep all historical records of information that you have provided to us and we may continue to use it to the extent that it is anonymized and no longer personally identifying. If you do not sign into your account or use the Site for an extended period of time, your account may be terminated in our sole discretion, and all your user information may be deleted. If your account information is deleted, either by us or you, we may retain copies of all deleted information, which will remain subject to this Privacy Policy in all respects, including permission sharing of such information.

6. Security of Your Information

You are responsible for keeping your account information and relevant passwords secret. We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. Do not share your password with anyone else.

7. Tracking Cookies and Tracking Technology Disclosure

Technologies such as cookies, beacons, tags, and scripts may be used by the Site and its marketing partners, affiliates, and analytics or service providers (e.g. user interaction and marketing analytics). These technologies are used in analyzing trends, administering the Site, tracking users’ movements around the Site, and gathering demographic information about the Site’s user base. We may receive reports based on the use of these technologies by these companies on an individual or aggregated basis. In addition, third-party service providers, including Google, may use these technologies in order to better provide you with advertisements relevant to your interests.

8. Information on Children

To access or use the Site you must be 16 years of age or older and, if under 18 or the age of majority in your jurisdiction, your use of the Site must be under the supervision of a parent or guardian or other responsible adult. If a parent or guardian becomes aware that his or her child has provided us with personal information without their consent, he or she should contact us at: info@hirediversity.us. If we become aware that a child under 16 has provided us with personal information, we will delete such information from our files and terminate the child’s account.
